Terms of Service

1. Who we are

These Terms govern your use of the South Sudan Smart DRR platform ("Service"), operated by the Ministry of Humanitarian Affairs and Disaster Management ("we", "us", "Seller"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms.

2. The Service

The Service provides AI-assisted climate, hazard, early-warning and humanitarian intelligence for South Sudan, delivered through a web dashboard, downloadable reports, and an optional data API.

3. Accounts and acceptable use

You must provide accurate registration information and keep your credentials confidential. You agree not to misuse the Service, including: unlawful use, fraud or spam, infringing intellectual property, uploading malware, probing or scanning our systems, or scraping content outside the API limits.

4. Intellectual property

We retain all rights, title and interest in the Service, including software, documentation, datasets we produce, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. You may not reverse engineer, resell, or redistribute the Service.

5. Payments, subscriptions and billing

Paid plans are billed in advance on a monthly or annual basis. Upgrades and downgrades take effect immediately. Cancellations take effect immediately and end access to paid features. Payment, billing, tax, cancellation and refund mechanics are handled by Paddle and are governed by the Paddle Buyer Terms.

6. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

7. Service availability

We work to keep the Service reliable but do not guarantee uninterrupted or error-free operation. Forecasts, alerts and risk indices are provided for decision-support and do not replace official government guidance.

8. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may stop using the Service at any time by cancelling your subscription.

9. Disclaimers and liability

To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose. Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. We are not liable for indirect or consequential damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury where it cannot be excluded by law.

10. Changes

We may update these Terms from time to time. Material changes will be communicated in-app or by email at least 14 days before they take effect.
